Elon Musk officially began his testimony in the trial he has brought against Open AI CEO Sam Altman and company president Greg Brockman.

The three were on the initial founding team of Open AI, with Musk investing up to $38 million early on before the co-founders’ relationship soured over disagreements over company structure and mission, including whether or not Open AI should be folded into Musk-owned Tesla. Musk walked away and, years later, founded x AI — his own direct competitor to Open AI, which is now owned by Musk’s Space X.

In recent years, Musk has filed no less than four different lawsuits against Open AI, many of which have since been dropped or dismissed. This one, though, names Altman, Brockman, Microsoft, and Open AI itself as plaintiffs, and it has made it to jury trial in a California federal courtroom. It’s expected to draw testimony from AI industry leaders, including Microsoft CEO Satya Nadella, Microsoft CTO Kevin Scott, and former Open AI CTO Mira Murati (who is now the founder of her own AI company, Thinking Machines Lab).

The crux of the suit alleges that Open AI violated its core mission to build AGI, or artificial general intelligence, that benefits all of humanity, and it also makes allegations of potential fraud, unjust enrichment, and breach of Open AI’s charitable trust. Musk is calling for the court “to strip Sam Altman and Greg Brockman of their positions of authority and the personal financial benefits they extracted from Open AI’s illicit for-profit operations and conversion” and to unwind Open AI’s for-profit restructuring, among other things.
